SCOPE OF PRACTICE

Pursuant toSDCL 36-9A-12, in addition to the RN scope of practice, as defined in SDCL 36-9-3 , and within the certified nurse practitioner's (CNP) role and population focus, a CNP may:

(1)    Conduct an advanced assessment;

(2)    Order and interpret diagnostic procedures;

(3) Establish primary and differential diagnoses;

(4) Prescribe, order, administer, and furnish therapeutic measures as follows:

(a)    Diagnose, prescribe, and institute therapy or referrals of patients to health care agencies, health care providers, and community resources;

(b)    Prescribe, procure, administer, and furnish pharmacological agents, including over the counter, legend, and controlled drugs or substances listed on Schedule II in chapter 34-20B ; and

(c)    Plan and initiate a therapeutic regimen that includes ordering and prescribing nonpharmacological interventions, including durable medical equipment, medical devices, nutrition, blood and blood products, diagnostic, and supportive services including home health care, hospice, and physical and occupational therapy; and

(d) Write a chemical or physical restraint order when the patient may do personal harm or harm others;

(5)    Perform a physical examination for the determination of participation in athletics or employment duties;

(6)    Complete and sign official documents such as death certificates, birth certificates, and similar documents required by law; and

(7)    Delegate and assign therapeutic measures to assistive personnel.

Practice Guides

CNPs are encouraged to use the APRN Scope of Practice Decisioning Algorithm to guide decision making on whether a specific task, intervention, or activity is, or is not, in a CNP's scope.

COLLABORATION REQUIREMENTS

All CNPs are expected to collaborate with other health care providers and refer or transfer patients as appropriate, p ursuant to SDCL 36-9A-13.1 . To practicewithout a collaborative agreementa CNP must have on file with the Board office a completedPractice Verification Form to verify a minimum of 1,040 licensed practice hours within the role of a CNP.  The Board'sVerification Site provides information on a CNP's practice authority status.

According to SDCL 36-9A-1 (6) , collaboration is defined as " the act of communicating pertinent information or consulting with a licensed physician or other licensed health care provider with each provider contributing the provider's respective expertise to optimize the overall care delivered to the patient".

TElehealth requirements

All healthcare providers are expected to adhere to the requirements inSDCL 34-52 when treating patients in the state through telehealth.  SDCL 34-52 includes the definition of telehealth and the requirements for treatment of patients, provider-patient relationship and exceptions, consultation recommendations, examination, prescribing, informed consent, and medical records.

PRESCRIBING

Upon licensure a CNP may prescribe, procure, furnish, and administer over-the-counter, legend, and controlled substance (CS) drugs (schedules II-IV as listed inSDCL 34-20B)within the CNP's role and focus area. CNPs who order CS drugs must meet requirements and be registered with the:

Applicable Rule 20:62:03:11 -- Regarding providing drug samples, documentation guidelines for prescribing CS drugs for treatment of chronic, non-cancer pain, and state and federal registration requirements.

Buprenorphine Treatment for treating opioid use disorder.  The Substance Abuse and Mental Health Services Administration (SAMHSA) allows eligible SD licensed CNPs to qualify for a DATA-waiver to prescribe buprenorphine for opioid dependency treatment. Resources and Information can be found at: https://www.samhsa.gov/medication-assisted-treatment/become-buprenorphine-waivered-practitioner.
